SAAGA Health Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the SAAGA Health mobile application and related services provided by SAAGA Health, Inc., a Delaware corporation (“Saaga Health,” “we,” or “us”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility and Access

You must be at least 18 years old to use the App.

The App is not directed to minors or children under 18, and we do not knowingly collect personal information from them.

The App is currently intended for use by residents of the United States. If you access the App from outside the United States, you do so at your own risk and are responsible for complying with local laws. We do not represent that the App is appropriate or available for use in other jurisdictions.

You must create an account to access most features.

2. Purpose and Disclaimer

SAAGA Health is a digital wellness application designed to provide educational content, cycle tracking, symptom logging, and personalized insights.

The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition.

Nothing in the App constitutes medical advice, diagnosis, or treatment. Always seek advice from a qualified healthcare provider with any questions about a medical condition.

The App is not suitable for emergencies. If you are experiencing a medical emergency, call 911 or your healthcare provider immediately.

Predictions or insights provided by the App (such as fertile days, ovulation timing, or cycle forecasts) based on statistical models and user-input data are not guaranteed to be accurate. The App should not be relied upon as a contraceptive method or fertility treatment. Do not use the App as your sole method for contraception, pregnancy planning/confirmation, or medical decisions.

Some features of the App use artificial intelligence and large language models. AI-generated outputs may not always be accurate, complete, or up to date. They are provided for general informational purposes only and should never be relied upon as medical advice or used as a substitute for consultation with a qualified healthcare professional.

Your use of the App does not create a doctor–patient, therapist–client, or other healthcare professional relationship.

3. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes.

You may not copy, modify, distribute, resell, reverse engineer, or otherwise exploit the App or its content.

All rights not expressly granted remain with Saaga Health and its licensors.

4. Prohibited Uses
You agree not to use the App to:

Upload or transmit viruses, malware, or harmful code.

Violate any applicable law.

Harass, threaten, or harm others.
-
Attempt unauthorized access to servers or systems.
-
Resell, sublicense, or make commercial use of the App.

5. User Content and Data

Any information you input into the App (“User Content”) remains yours.

You are solely responsible for the accuracy and completeness of the information you enter into the App. The quality of the insights and predictions depends on the accuracy of the data you provide.

We will never sell your personal information to advertisers or data brokers.

By using the App, you grant Saaga Health a limited license to process your User Content solely to provide App functionality.

We may use anonymized or aggregated data derived from User Content to improve services, conduct research, or develop new features. Any research or analytics we conduct uses aggregated or anonymized data that cannot identify you personally.

If you choose to delete your account, your personal data will be permanently deleted within 30 days, except where we are legally required to retain it for longer (for example, to comply with financial, legal, or regulatory obligations). Aggregated and anonymized data that does not identify you may be retained to improve our services.

6. Limitations of Technology

Accuracy depends on the quality and completeness of the data you provide.

Biological variability, irregular cycles, underlying conditions, or inconsistent data entry may reduce accuracy.

Some features are powered by AI and large language models. Outputs may not always be accurate and are not a substitute for professional judgment.

We work to keep the App reliable and secure, but cannot guarantee it will always be free from errors or interruptions.

7. Privacy and Security

Your privacy is important to us. Personal and health data are collected, processed, and stored in accordance with our Privacy Policy.

We use encryption in transit and at rest to help protect data.

Certain third-party service providers may process your data to deliver the App; details are in our Privacy Policy.

Your information may be processed and stored in the United States and in other countries where we or our service providers operate. Data protection laws in these locations may differ from those in your place of residence. By using the App, you consent to this transfer and processing.

If legally required, we will notify you in the event of a data breach.

SAAGA Health is not a “covered entity” or “business associate” as defined under the Health Insurance Portability and Accountability Act (HIPAA). While we take reasonable steps to safeguard your information, the App is not subject to HIPAA and should not be considered a substitute for regulated healthcare services.
8. Fees, Payments, and Refunds

Some features may be offered free, at a discount, or through promotional access.

Paid features may include subscription plans.

Payments are processed through third-party platforms (Apple App Store, Google Play, Stripe).

Free trials, if offered, will automatically convert to paid subscriptions unless canceled before the trial ends.

Refunds and cancellations follow the policies of the platform used for purchase. Saaga Health does not provide refunds for partially used billing periods unless required by law.
9. Termination and Account Deletion

You may delete your account and data at any time through the App or by contacting us.

We may suspend or terminate accounts that violate these Terms or pose security/legal risks.

Upon deletion, your data will be removed unless retention is legally required.

10. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind.

We make no warranties regarding accuracy, reliability, or completeness.

To the fullest extent permitted by law, we disclaim all express and implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

You use the App at your own risk.

11. Intellectual Property

All SAAGA branding, content, software, and designs are owned by Saaga Health, Inc. or its licensors.

You may not copy, modify, resell, rent, lease, loan, sublicense, or distribute App content or Saaga branding without permission.

12. Errors and Omissions

While we strive to provide accurate and reliable information, Saaga Health does not guarantee that the App or its content will always be free from mistakes, omissions, or inaccuracies.

Information in the App may not always reflect your individual health situation.

You are responsible for verifying important information with a qualified healthcare provider before making health or medical decisions.

13. Limitation of Liability

General Rule: To the maximum extent permitted by law, Saaga Health and its affiliates are not liable for any direct, indirect, incidental, consequential, or special damages arising out of your use of the App.

Examples of Excluded Claims: This includes, but is not limited to:

Reliance on inaccurate predictions.
-
Missed, abnormal, or unintended pregnancies.
-
Health outcomes based on information from the App.
-
Loss of profits, business opportunities, or data.

Damages Cap: Our total liability for any claim is limited to the greater of: USD $100, or the amount you paid to Saaga Health in the 12 months before the claim.

Why This Limitation Exists: The App is an educational tool, not a medical service. Because health outcomes depend on many factors outside our control, Saaga Health cannot assume financial responsibility for medical or personal results of using the App.

Exceptions: Some states do not allow exclusion of implied warranties or limitation of liability for certain damages. In those cases, parts of this section may not apply to you.

We are not responsible for any service interruptions, delays, unauthorized access, loss of data, or other issues caused by factors outside of our reasonable control (such as internet outages, third-party service failures, or cyberattacks).

14. Indemnification
You agree to indemnify and hold harmless Saaga Health, its officers, employees, advisors, and partners from claims or damages arising from your use of the App or violation of these Terms.

15. Modifications

We may update or discontinue the App at any time.

These Terms may be updated periodically. Material changes will be communicated via the App or email.

Continued use after updates means you accept the revised Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA.

Disputes shall be handled exclusively in the courts of Delaware.

Claims must be brought individually, not as part of a class action.

Any cause of action must be commenced within one year of arising.
17. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
18. Notices

Notices to you may be delivered via email, in-app notification, or other reasonable means.

At Saaga Health, we value your privacy and are committed to protecting your personal information. This Privacy Policy explains how we collect, use, store, and share your data when you use the App.
1. Information We Collect

Health and Cycle Data: period dates, symptoms, health goals and related concerns and focus areas, medications, chronic conditions, lifestyle factors.

Optional Information: potential upcoming data integration from wearables or other apps, responses to surveys, or information you choose to share with us.
2. How We Use Information
We only use your information to:

While no system is 100% secure, we take appropriate technical and organizational steps to protect your information.
5. Your Rights and Choices

Access, update, export, or delete your information at any time.

Opt out of receiving newsletters or marketing communications.

Delete your account, after which your personal data will be removed unless we are legally required to keep certain records.
6. Data Retention
We retain your personal data for as long as your account is active. Once your account is deleted, your personal data will be permanently deleted within 30 days, except where retention is required by law. Aggregated or de-identified data that cannot be linked back to you may be retained for research and product development.
7. Data Breach Notification
If a breach involving your personal data occurs, we will notify you as required by law. Notices may be delivered by email, in-app message, or other reasonable means.
8. Children’s Privacy
The App is intended for individuals 18 years or older. We do not knowingly collect information from children. If we learn that information from a child has been collected, we will delete it promptly.
9. U.S. Use and California Rights
The App is designed for users in the United States.

We comply with applicable U.S. privacy laws, including the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA).

If you access the App from outside the United States, your information may be processed and stored in the United States and in other countries where we or our service providers operate. Data protection laws in these locations may differ from those in your country of residence.
11. Changes to Policy
We may update this Privacy Policy from time to time. If material changes are made, we will notify you in the App or by email. Your continued use of the App after changes take effect means you accept the updated Policy.
